Welcome to KaiwaBloom! These Terms of Use ("Terms") govern your access to and use of the KaiwaBloom mobile application ("App") and related services ("Services") available on Apple App Store and Google Play Store.

 

By using KaiwaBloom, you agree to these Terms. If you do not agree, please do not use the App.

1. Eligibility

KaiwaBloom is available for users of all ages. However, if you are under the age of 18, we recommend using the app under parental guidance. By creating an account or using the app, you confirm that you agree to these Terms.

 

2. Account Registration & Security

  • To access certain features, you may be required to register for an account.

  • You agree to provide accurate, current, and complete information and update it if necessary.

  • You are responsible for maintaining the confidentiality of your account credentials.

  • If you suspect unauthorized access to your account, notify us immediately at yuto@kaiwabloom.com.

 

We reserve the right to suspend or terminate accounts found to be in violation of these Terms.

 

3. Use of the App

When using KaiwaBloom, you agree:

  • To use the App only for personal, non-commercial purposes.

  • To comply with all applicable laws and regulations.

  • To respect the intellectual property rights of KaiwaBloom and other users.

Prohibited Activities:

  • Copying, modifying, distributing, or exploiting any part of the App without permission.

  • Using the App for illegal, fraudulent, or malicious activities.

  • Attempting to disrupt, hack, or manipulate the App's functionality.

Violating these rules may result in account suspension or termination.

4. Subscriptions & Payments

KaiwaBloom offers free and premium plans with additional features.

Payment & Subscription Details:

  • Payments are processed securely via Apple App Store and Google Play Store.

  • Subscriptions automatically renew unless canceled at least 24 hours before the next billing cycle.

  • Subscription management (including cancellation) must be done through your Apple or Google account settings.

 

Refund Policy:

  • Refunds for purchases follow the policies of Apple and Google.

  • Refund requests must be made through the App Store or Play Store, where applicable.

5. Intellectual Property Rights

All content in KaiwaBloom, including text, images, audio, software, and branding, is owned or licensed by KaiwaBloom.

Restrictions:

  • You may not copy, reproduce, distribute, or use the App’s content without permission.

  • The KaiwaBloom logo and branding are protected trademarks and cannot be used without prior authorization.

 

Violating intellectual property rights may result in legal action.

 

6. User-Generated Content

If you create custom learning items, notes, or other content within KaiwaBloom:

  • You retain ownership but grant KaiwaBloom a non-exclusive license to use, modify, and display your content.

  • We reserve the right to remove any content that violates these Terms or applicable laws.

Prohibited Content:

  • Hate speech, harassment, or offensive material.

  • Copyrighted content without proper authorization.

  • Any content that violates applicable laws.

 

7. Disclaimers & Limitations of Liability

  • Educational Use Only: KaiwaBloom is designed for learning purposes only and does not guarantee fluency.

  • No Warranties: The App is provided "as is", without warranties of any kind.

  • Limited Liability: We are not responsible for any data loss, service interruptions, or damages resulting from using the App.

  • We do not guarantee that the App will be error-free or uninterrupted.

 

Important: We are not liable for any losses or damages resulting from your reliance on the App’s content.

 

8. Termination of Service

We reserve the right to suspend or terminate your account if:

  • You violate these Terms.

  • You engage in fraudulent, abusive, or harmful activities.

  • You attempt to hack, exploit, or interfere with the App’s functionality.

 

If your account is terminated, you will lose access to all content and features.

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of Japan, without regard to conflict of law principles.

If disputes arise, we encourage you to contact us first at yuto@kaiwabloom.com to resolve the issue.

 

10. Modifications to These Terms

We may update these Terms of Use at any time. Changes will be notified in-app or via email.

Your continued use of the App after changes indicates acceptance of the revised Terms.
